1. About RespondAI

RespondAI is an AI-powered customer communication platform that helps businesses engage website visitors, answer questions, collect leads, manage conversations, and communicate with prospective customers through AI-powered assistants and messaging tools.

The Services may include:

• AI website chatbots
• AI-powered lead qualification
• Lead management (CRM)
• Website contact forms
• Direct chatbot pages
• SMS conversations
• AI-generated responses
• Conversation history
• Team collaboration
• Website knowledge scanning
• Third-party integrations
• Analytics and reporting

Features may change over time.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement.

If you use RespondAI on behalf of a company or organization, you represent that you have authority to bind that organization to these Terms.

3. Accounts

You are responsible for:

• Maintaining accurate account information
• Protecting your password
• All activity occurring under your account
• Promptly notifying us of unauthorized access

You are responsible for your team members and anyone you invite into your company workspace.

4. Free Trial

RespondAI may offer a free trial.

During the trial you may receive:

• Access to all or selected features
• A monthly AI message allowance
• Limited team seats
• Limited integrations

Unless canceled before the trial ends, your subscription will automatically convert to the selected paid plan.

5. Subscription Plans

RespondAI offers recurring subscription plans.

Subscriptions renew automatically until canceled.

Plans may include:

• Monthly subscriptions
• Annual subscriptions
• Additional message purchases

Subscription pricing is displayed before purchase.

6. Message Allowances

Subscriptions include a monthly AI message allowance.

Unused monthly messages do not roll over.

Additional purchased message packs:

• Never expire
• Are consumed only after monthly included messages are exhausted
• Are non-refundable except where required by law

RespondAI may update message limits or pricing with reasonable notice.

7. Billing

Payments are processed securely through Stripe.

RespondAI does not store complete payment card information.

By subscribing, you authorize recurring charges according to your selected plan.

You agree to keep your payment information current.

8. Cancellation

You may cancel your subscription at any time through your account billing settings.

Cancellation prevents future renewals.

You will continue to have access until the end of your current billing period.

RespondAI does not provide prorated refunds except where required by law.

9. Acceptable Use

You agree not to use RespondAI to:

• Send spam
• Send unsolicited marketing in violation of applicable law
• Promote illegal activity
• Harass or threaten others
• Upload malicious software
• Attempt unauthorized access
• Reverse engineer the platform
• Interfere with system performance
• Upload unlawful or infringing content
• Generate fraudulent or deceptive communications

We reserve the right to suspend or terminate accounts violating these Terms.

10. AI Responses

RespondAI uses artificial intelligence to generate responses.

AI-generated responses may:

• Contain errors
• Be incomplete
• Misinterpret information
• Produce inaccurate recommendations

You remain solely responsible for reviewing AI-generated communications before relying upon them.

RespondAI does not guarantee the accuracy or suitability of AI-generated responses.

11. Customer Content

You retain ownership of:

• Uploaded documents
• Website content
• Company knowledge
• Photos
• Lead information
• Conversation history

You grant RespondAI a limited license to process this information solely for providing the Services.

12. Website Scanning

If you provide a website URL, RespondAI may automatically scan publicly accessible pages to generate company knowledge.

You represent that you have authority to authorize such scanning.

You may edit or remove generated knowledge at any time.

13. Lead Data

RespondAI collects information submitted by website visitors, which may include:

• Name
• Phone number
• Email address
• Address
• Uploaded photos
• Conversation history
• Custom lead form fields

You are responsible for complying with all applicable privacy laws governing your customers.

14. SMS Communications

RespondAI may send and receive SMS messages using supported providers.

You are responsible for ensuring you have appropriate consent before communicating with customers by text message.

Carrier fees may apply.

15. Third-Party Services

RespondAI integrates with third-party services, including but not limited to:

• Stripe
• Twilio
• OpenAI
• HubSpot
• Resend
• Other supported integrations

RespondAI is not responsible for outages, policy changes, or actions of third-party providers.

16. Availability

We strive to maintain reliable service but do not guarantee uninterrupted availability.

Maintenance, outages, software updates, and third-party failures may temporarily affect the Services.

17. Intellectual Property

RespondAI and all associated software, branding, trademarks, interfaces, graphics, and documentation remain our exclusive property.

You may not copy, distribute, modify, or create derivative works except as expressly permitted.

18. Feedback

Any feedback, suggestions, or feature requests you provide may be used by RespondAI without restriction or compensation.

19. Suspension and Termination

We may suspend or terminate accounts that:

• Violate these Terms
• Present security risks
• Abuse the platform
• Fail to pay required fees
• Engage in fraudulent activity

Termination may result in loss of access to stored data after a reasonable retention period.

20. Limitation of Liability

To the maximum extent permitted by law, RespondAI shall not be liable for:

• Lost business opportunities
• Lost revenue
• Lost data
• Indirect damages
• Incidental damages
• Consequential damages

Our total liability shall not exceed the amount you paid to RespondAI during the twelve months preceding the event giving rise to the claim.

RespondAI makes no warranties regarding:

• Availability

We do not guarantee that AI-generated responses will always be correct or appropriate.

• Your uploaded content
